Patient rights and medical treatment claims

We also advise patients on treatment-related disputes, subject to a conflict-of-interest check. Our assessment focuses on the medical records, the treatment concerned, the alleged breach and the resulting harm.

Records and an initial assessment

A chronology, existing correspondence and relevant treatment records help us understand the matter. Please begin with a short description and identify the parties involved. We will explain which records are needed and how to provide sensitive documents securely.

Treatment, information and documentation

An unfavourable outcome is not by itself proof of a treatment error. Questions may concern the standard of treatment, the information given before consent or the quality of documentation. Expert medical evidence is often important. The burden of proof and any statutory exceptions must be assessed for the particular issue.

Compensation and resolution

Depending on the case, a claim may concern financial losses, additional care needs, lost earnings or compensation for pain and suffering. We assess causation and evidence of loss separately. Negotiation with the provider or insurer, an appropriate conciliation procedure or litigation may be considered.

Time limits and costs

Limitation periods do not simply run from the treatment date in every case. Knowledge and other statutory rules can matter. We review the circumstances, available funding or insurance and the likely cost of the proposed steps before agreeing the assignment.
