Legal advice for healthcare providers in Germany

English home · Contact us

We support healthcare providers and facilities in commercial decisions, day-to-day legal matters and disputes. Our work connects healthcare regulation with corporate, employment, technology and litigation issues.

Buying, selling and transferring a practice

We advise on practice acquisitions, succession and professional partnerships. The transaction documents, regulatory approvals and operational handover need to work together. We review the purchase structure, premises, equipment, staff, patient records and allocation of liabilities. Early planning helps identify approvals and contractual conditions before a binding commitment is made.

Medical care centres and professional partnerships

Medical care centres (MVZ), group practices (BAG) and cooperation arrangements combine corporate and regulatory questions. We advise on formation, ownership and governance, medical leadership, entry and exit provisions and cooperation agreements. Commercial arrangements must also reflect professional rules, statutory health insurance requirements and the independence of medical decisions.

Admission to statutory health insurance practice

We assist doctors and organisations with admission, employed physician positions, succession procedures and branch practices. The competent admissions bodies and the relevant regional Association of Statutory Health Insurance Physicians (KV) may have different roles. We review the proposed structure, application documents and available responses to adverse decisions, including urgent protection where appropriate.

Fees, billing reviews and recourse claims

Billing disputes can concern statutory health insurance remuneration, private medical fees, plausibility reviews or efficiency reviews. We analyse the decision and calculation, the services provided and their documentation. We help prepare objections and responses, negotiate where appropriate and assess the prospects and costs of litigation. Deadlines in notices should be checked immediately.

Hospitals, private clinics and rehabilitation facilities

We advise on contracts, cooperation, organisational structures and regulatory matters affecting hospital operations. Hospital planning, financing and remuneration need to be considered alongside staffing and service delivery. We assess proposed arrangements and official decisions in their specific legal and regional context, including the consequences of healthcare reform for the individual facility.

Defending medical liability claims

For practices and facilities facing allegations of treatment errors, we coordinate the legal assessment with the available clinical documentation and expert evidence. We advise on preservation of records, communications with the claimant and notification of insurers. Liability, causation and loss require separate analysis. A negotiated settlement may be appropriate, but should be based on a clear assessment of evidence, cover and future risks.

Professional licensing and criminal defence

Allegations involving treatment, billing or improper benefits can affect criminal proceedings, professional discipline and the right to practise. We help coordinate the response across these proceedings. Before submitting substantive statements, we assess the allegations, available records and procedural position. A settlement of a civil claim does not automatically end criminal or regulatory proceedings.

Employment and senior physician contracts

We advise on employment contracts, senior physician agreements, remuneration structures and the organisation of medical work. We also assist with changes in responsibilities, separation negotiations and employment disputes. Dismissal challenges and contractual or collective time limits can require prompt action. The employment and regulatory aspects of the working arrangement should be assessed together.

Care providers, therapists and pharmacies

Care facilities, therapy practices and pharmacies face their own requirements concerning authorisation, remuneration, contracts and supervision. We review the legal framework for the particular profession or business, rather than treating all providers as interchangeable. Advice may include cooperation, employment, transactions and disputes with contracting partners or authorities.

Digital health, health data and medical devices

Digital care projects raise questions about data protection, professional confidentiality, software contracts and medical device regulation. We review responsibilities, data flows, service arrangements and the intended use of a product. Whether software is a medical device depends on its purpose and applicable rules. We also advise on intellectual property and contractual protection for healthcare technology.

Please tell us about your organisation, the issue and any deadlines. We will check conflicts of interest and agree the scope of our work and fees before accepting instructions. Discuss your matter.
